Hello hello everyone! Welcome to our hopefully concise Terms & Conditions section. As you already know, Mentors CX wishes to help people and brands achieve positive interactions through amazing customer experience - enabling mentorships that will help guide mentees.

A quick reference:

When the terms 'us,' 'we,' 'our' are used, they refer to Mentors CX LLC, the entity operating and providing this website and its services to members, users, mentees, mentors, and customers.

By accessing or using our website, you accept and are bound by these Terms of Services (ToS) as detailed here.

Please take a moment to thoroughly review our ToS and agree to them before using our website. If you disagree, kindly refrain from using our website and services.

2. Acceptance of Terms:

Our platform serves as a space for mentees to directly connect with seasoned CX professionals for advice and mentoring. While users can browse our website freely, registration is mandatory for accessing our services. We do not endorse any members, users, mentees, mentors, or clients, but accurate information is required from all third parties we collaborate with.

We are not party to agreements between mentors and mentees, and we lack control over their conduct, disclaiming responsibility for information or advice exchanged. We are not liable for losses or damages resulting from reliance on information provided through our website or services. The right to refuse or restrict services to anyone or any jurisdiction is reserved.

Reproduction, duplication, or unauthorized exploitation of our services is prohibited without express written permission. Modification or discontinuation of any service content may occur without notice. Transmitting viruses or engaging in illegal or unauthorized activities is strictly prohibited.

Violation of the Terms of Service will lead to immediate termination of services. Any new features added to our website are subject to these Terms of Service. The most up-to-date version of the Terms of Service can be found on this page, with the right reserved to update, amend, or replace any part. Users are responsible for checking our website for changes, and continued use implies acceptance of the current or amended Terms of Service.

Our services are exclusively intended for individuals aged 18 or older. Any access or use by individuals under 18 is expressly prohibited.

Transmission or uploading of viruses, malware, spam, phishing, scraping, or crawling is prohibited and could impact the operation of our services.

You acknowledge that the details you provide may be transmitted through international networks, potentially undergoing format adaptations for these transfers. Payment information will exclusively be transmitted in encrypted formats. The submission of personal information on our website is governed by our Privacy Policy, accessible through this link.

Regarding our connections with Third Parties, we make it explicitly clear on our website when we collaborate with or actively endorse a third party. Certain content and services on our website may incorporate material from third parties. We disclaim responsibility for monitoring or assessing the content on these third-party websites, and we assume no responsibility for any materials, websites, or links not affiliated with third parties.

While we may provide access to third-party tools, your use of such tools is entirely at your own risk, and we bear no liability arising from or relating to your use of them. We are not responsible for any harm or damages related to the use of services, resources, content, or any other transactions. Complaints concerning third-party services should be directed to the relevant third party. 6. Pricing

MentorsCX operates on a subscription-based model, offering valuable services to its members, including access to mentors with rates listed as free or paid. Subscriptions are intended for individual use and cannot be shared. Sharing services with a non-registered person will result in a suspension of services.

The pricing of our services is subject to change at any time without prior notice and at our discretion. We are not liable for any modification, price change, suspension, or discontinuance of our services.

Fees for Mentors

The price per hour is determined by the mentor and set in the hourly rate section of their profile. These fees, quoted in US Dollars and corresponding to session lengths (15 min, 30 min, 45 min, or 60 min), will be clearly listed on the website. We collect a 9% service fee directly from the payment received from the mentee and remit the remaining funds to the mentor via Stripe in US Dollars. Service fees are non-refundable. Any changes to fees or payment methods will be communicated in writing prior to implementation.

Fees for Mentees

Besides paying for the membership plan, you have the choice to book paid sessions. You are responsible for paying the fees associated with completed sessions. Upon booking a session, we or our authorized third-party payment processor will collect fees via your credit card. To facilitate payment processing, you will be required to provide billing information, including name, billing address, and credit card details. Transactions processed by a third-party processor are subject to their terms, conditions, and privacy policy. Review these terms before using the services, and check for any fees charged by your credit card provider. We disclaim liability for credit card processing transactions charged by your provider.

By booking a session, you authorize us to charge your credit card for the fees associated with your selected mentor on our website. Ensure you provide accurate billing information for seamless transactions and communication.

7. Fair Usage Policy

To ensure equitable access to our mentors and prevent any single user from monopolizing their time, we may, at our discretion, implement a fair usage policy. An automatic cap of 20 sessions per month will be activated if a mentee requests more than 120 sessions within a 6-month period. However, if a mentee has a valid justification for exceeding this limit, they may appeal the cap. Each appeal will be reviewed on a case-by-case basis, and our decision will be final.

8. Non-Circumvention

All mentorship sessions must be scheduled within the MentorsCX platform. It is a violation of the terms of service for mentors or mentees to propose making or receiving a payment outside of the MentorsCX platform for services rendered and connections established via the MentorsCX platform.

9. Subscription Details

Your subscription will renew automatically unless you cancel your plan at least 24 hours before the current subscription period ends. Your account will be charged for the renewal within 24 hours prior to the end of the current subscription period. Automatic renewals will be charged at the same price as your initial subscription, unless there was a one-time promotion.

10. Refunds

Refunds are available within 21 days of the membership start date if no calls have been scheduled in the system. Refund options are forfeited when a call with a mentor is requested and accepted within the platform, or when the direct messaging function has been used to solicit advice from mentors or connect outside of the platform. 11. Severability

Should any provision of these Terms of Service be deemed unlawful or unenforceable, the provision shall remain applicable as permitted by law. Any provision deemed void will be removed from the Terms of Service without affecting the validity of the remaining provisions.

12. Termination

Termination of the Terms of Service occurs either when you cease using our services or when you notify us of your intention to no longer use our services. We reserve the right to amend or update these Terms of Service. We may terminate the provision of our services without notice if we suspect non-compliance with any provision in the Terms of Service. Any outstanding payments at the time of termination must be settled in full.

13. Membership Termination

To cancel your membership, log into the billing area in settings and select 'cancel subscription.'

14. Attendance Policy

The administration retains the right to revoke membership in the event of attendance issues. Members must respect the time of the mentors and schedule responsibly.

15. Enforcement

We reserve the right, though not obligated, to investigate any violation of these Terms. We may investigate violations and may remove, disable access to, or modify any content that violates these Terms.

16. Defamatory Reviews

We reserve the right to remove reviews that fail to meet minimum quality standards, including, but not limited to, those copied from other sources, containing defamatory comments, or indicating a punitive nature and intent.

17. Limitation of Liability:

We do not guarantee that our services will be uninterrupted, timely, secure, or error-free. You acknowledge that occasional removal of our services may occur without prior notice.

In no event shall we, our officers, directors, service providers, contractors, employees, and agents be liable for any injuries, losses, claims, or any direct, indirect, incidental, or consequential damages, including lost profits or revenue, loss of data, loss of goodwill, replacement costs, service interruption, system failure, or any similar damages. This applies whether based on contract, tort (including negligence), strict liability, or otherwise, arising from your use of any services procured from us, including errors or omissions in any content, or any loss or damage incurred as a result of using our services or content.

We do not warrant that the results obtained from using our services will be accurate or reliable and disclaim liability for communications or interactions with third persons or parties resulting from your use of our website.

Our liability is limited to the maximum extent permitted by law. In no event will our aggregate liability arising from or connected to these Terms of Service exceed the amount paid or owed for sessions arranged via our website in the 12-month period preceding the event giving rise to the liability, or 250 US Dollars.

18. Indemnification

You agree to indemnify, defend, and hold us and our affiliates, along with their officers, directors, service providers, contractors, employees, and agents, harmless from any claims, liabilities, damages, losses, and expenses, including reasonable legal and accounting fees. This indemnification is related to (1) your access to or use of our website, its content, and services; (2) your violation of these Terms of Service; (3) any comments or information posted by you; (4) your interaction with any third parties or individuals arising from the use of our services; and (5) reliance on any material obtained from or via our services.

19. Entire Agreement

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service, along with any other operating rules on our website, constitute the entire agreement and understanding between you and us, governing your use of our services. This agreement supersedes any prior written or oral agreements between you and us, including earlier versions of the Terms of Service. Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

These Terms of Service are governed by and construed in accordance with the laws of the United States of America.
